New York Woman Secures $1.925 Million Settlement in Staircase Slip-and-Fall Case

A 38-year-old woman has obtained a $1.925 million settlement after suffering catastrophic injuries in a staircase slip-and-fall accident in New York, her legal representatives announced. The settlement, reached before trial, was secured by David Resnick & Associates, P.C., with attorney Philip Monier leading the case. The lawsuit, filed in the Supreme Court of the State of New York, New York County, alleged that the building owner and managing agent failed to maintain safe conditions on a wet and slippery staircase, leading to the woman's fall and severe injuries.

The woman sustained tears in the labrum of both hips, as well as injuries to her spine and neck. Following the accident, she was forced into induced labor and required surgical treatment to repair the hip tears, followed by extensive rehabilitation that confined her for several months. The injuries have significantly limited her ability to perform daily activities, including walking, bending, and sitting. She also cannot complete household chores, sit or stand for prolonged periods, or engage in usual activities with her children.

The building owner and managing agent argued that the fall occurred during a period of snow and cold-weather precipitation, contending they were not required to cover all floors with mats or continuously remove moisture tracked onto the stairs. They also claimed they did not create the wet conditions and lacked notice of them. However, the law firm was prepared to present medical and economic experts to demonstrate the extent of the woman's injuries and their lasting impact on her life, according to Monier, who has over 25 years of experience representing accident victims.

Monier emphasized the importance of full compensation for negligence-related accidents, stating that injured parties deserve compensation not only for past suffering but also for future challenges. The settlement proceeds will help the client manage ongoing pain and functional difficulties. This case underscores the responsibilities of property owners to ensure safe premises, particularly during inclement weather, and the severe consequences when those duties are neglected.
